Terms & Conditions for orders placed in the Lyconet Store(Version: March 2019)
a)Lyconet International AG with registered office in Austria, Orbi Tower, Thomas-Klestil-Platz 13, 1030 Vienna, and company registry number FN 503414s, operates a marketing program under the term "Lyconet" ("Lyconet Marketing Program").
An essential element of this Lyconet Marketing Program is the Lyconet Agreement which allows self-employed, commercially active sales agents to establish and promote their own customer loyalty program. Following the conclusion of the Lyconet Agreement with Lyconet International AG ("Lyconet") participants acquire the status of an Independent Lyconet Marketer ("Marketer").
Lyconet International AG is authorised by myWorld International Limited with registered office at 3rd Floor, 40 Bank Street, London E14 5NR, UK, to promote the Cashback World Program, among other things. The Cashback World Program is a shopping community operated by myWorld International Limited together with its subsidiary companies and cooperation partners, through which the participants ("Members") may purchase goods and services from Loyalty Merchants ("Loyalty Merchants") to receive benefits.
b)Lyconet uses mWS myWorld Solutions AG, Grazbachgasse 87-93, 8010 Graz, Austria, as a service provider when processing the Lyconet Marketing Program. As the supplier of the products of the Lyconet Store, mWS myWorld Solutions AG has agreed that myWorld International Limited together with the respective myWorld International Limited subsidiary company may sell the products of the Lyconet Store to Marketers. myWorld International Limited thus uses its respective subsidiary company when processing the purchase in each country. The myWorld subsidiary company stated at Annex 1, which has its registered office in the country in which the Marketer resides ("myWorld subsidiary company"), sells the products of the Lyconet Store under its own name and account.
To the extent that gender-specific terms are used in the contract content, this means both female and male persons as well as legal persons.
1.Completion of Contract
1.1.The Lyconet Store is aimed exclusively at Marketers as a part of their activity as Independent Lyconet Marketers. The use of the Lyconet Store by consumers as defined by the Consumer Protection Act is excluded.
1.2.By placing an order in the Lyconet Store, the Marketer places a binding purchase offer. The order confirmation sent automatically after completion of the purchase process does not at that time constitute an offer. The contract between the respective myWorld subsidiary company and the Marketer is only concluded by either the shipment confirmation or the actual shipment of the ordered goods.
Certain merchandising materials (hereinafter referred to as "Products") are offered in the Lyconet Store to assist the Marketers in their marketing activities.
3.Prices, shipping charges and delivery
3.1.All prices are quoted in the respective national currency; they include the legal VAT and exclude the shipping costs.
3.2.Shipping costs can apply in addition to the displayed product price. The cost of shipping will be calculated and communicated to the Marketer before the order is completed. This will vary depending on the size and weight of each order. The shipping costs do not include any customs duties.
3.3.The orders are sent via UPS, GLS, Fedex or by post. The delivery time can vary depending on the country of destination and weight. Delivery times are specified in the "Customer Services" menu item in the Lyconet Store.
3.4.Delivery is only possible by dispatch. Personal collection of goods is not possible. Delivery to parcel stations is not possible.
4.Payment and reservation of proprietary rights
4.1.The goods do not become the property of the Marketer until full payment.
4.2.The order can only be paid for by credit card. Any other methods of payment are not accepted.
4.3.Credit cards will be debited once the order has been processed.
5.1.Members of the Cashback World Program receive shopping benefits for shopping at the Lyconet Store in accordance with the general terms and conditions applicable to them at the time of purchase.
5.2.The amount of Shopping Benefits is stated in the detailed view of the respective product.
6.1.In order to process the order made via the Lyconet Store, Lyconet International AG with registered office in Austria, Orbi Tower, Thomas-Klestil-Platz 13, 1030 Vienna, and the respective myWorld subsidiary company stated at Annex 1, which has its registered office in the country in which the Marketer resides, collect, save and process the telephone number, e-mail address, country code, delivery address, Membership ID and tax number of the respective Marketer. Lyconet and the respective myWorld subsidiary company shall use mWS myWorld Solutions AG, Grazbachgasse 87-93, 8010 Graz, Austria, as a service provider and forwards the above-mentioned data to it for this purpose.
6.2.Credit card data is not saved or processed by Lyconet and the respective myWorld subsidiary company stated at Annex 1, which has its registered office in the country in which the Marketer resides. Global Collect Services B.V., Planetenweg 43-59, 2132 HM Hoofdorp, Netherlands (Ingenico ePayments) is used for the credit card payment process. 6.3.All inquiries regarding the information, modification and deletion of the personal data can be directed directly to Lyconet International AG, Orbi Tower, Thomas-Klestil-Platz 13, 1030 Vienna, Austria, email@example.com.
7.Right of exchange and transport damage
7.1.The exchange or return of any goods other than those specified in points 7.2. and 7.3. is excluded.
7.2.Defective or incorrectly delivered goods can be rejected within 14 days and be returned unused and in their original condition.

7.3.Goods with obvious transport damages must be reported to the delivery service as soon as possible. In addition, the Marketer must immediately report these damages. For the contact address, see point 7.2.
8.1.Lyconet or the respective myWorld subsidiary company, which has its registered office in the country in which the Marketer resides, are liable without limitation for damages arising from loss of life, personal injury or damage to health caused by an intentional or negligent breach.
8.2.Lyconet or the respective myWorld subsidiary company, which has its registered office in the country in which the Marketer resides, also have unlimited liability for all other damages caused by an intentional breach of their duties.
8.3.For other damages caused by a grossly negligent breach of the duties of Lyconet or the respective myWorld subsidiary company, which has its registered office in the country in which the Marketer resides, their liability is limited to typical and foreseeable damage.
8.4.For damages caused by the simple negligent breach of material contractual duties that are essential for the appropriate and proper execution of the Contract, the liability of Lyconet or the respective myWorld subsidiary company, which has its registered office in the country in which the Marketer resides, is limited to typical and foreseeable damage.
8.5.Any other claims for damages are barred, except in accordance with Clause 8.6 below. This especially applies to initial deficiencies where liability is independent of blame.
8.6.If the liability of Lyconet or the respective myWorld subsidiary company, which has its registered office in the country in which the Marketer resides, is limited or excluded, the limitation or exclusion also applies to the personal liability of their employees, legal representatives and agents. The liability of Lyconet or the respective myWorld subsidiary company, which has its registered office in the country in which the Marketer resides, pursuant to the Austrian Product Liability Act remains unaffected by the liability limitations and exclusions in Clause 8.
9.Jurisdiction and general provisions
9.1.This agreement is subject to Austrian law under exclusion of the private international law and the UN sales law.
9.2.The exclusive legal jurisdiction for all disputes arising from or in connection with these Additional Terms and Conditions is the duly appointed court at Lyconet's registered office.
9.3.The contract is available in German and English.
